1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of AQYL, including our website at im.aqyl.io, mobile applications, and related services (collectively, "Services"). AQYL is operated by AQYL ("we," "us," or "our").
By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.
2. About AQYL
2.1 End-to-End Encryption
AQYL provides end-to-end encrypted messaging using AES-256-GCM encryption with ECDH P-256 key exchange. Your messages are encrypted on your device before transmission and can only be decrypted by the intended recipient. We cannot read your messages, view your media, or listen to your calls.
2.2 Self-Hosted Infrastructure
AQYL operates on self-hosted infrastructure, giving us full control over data handling and security. Your data is not processed by third-party cloud providers for core messaging functionality.
2.3 No Data Harvesting
We do not harvest, sell, or monetize your personal data. We do not display third-party advertisements. We do not use your data for targeted advertising or share it with data brokers. Your private communications remain private.
2.4 Communication Services
Our Services enable you to send encrypted text messages, share photos and files, make voice and video calls, create group conversations, and share your location with contacts you choose.
3. Eligibility
You must be at least 13 years old to use AQYL. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using our Services, you represent that you meet these eligibility requirements.
4. Account Registration
To use AQYL, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
- Not share your account credentials with others
- Not create multiple accounts for abusive purposes
Your encryption keys are generated and stored locally on your device. If you lose access to your device and have not backed up your keys, you may permanently lose access to your message history.
5. Acceptable Use Policy
You agree to use our Services only for lawful purposes. You must not:
- Violate any applicable local, state, national, or international laws
- Send unsolicited bulk messages (spam) or automated messages
- Harass, threaten, stalk, or intimidate other users
- Share content that exploits minors in any way
- Distribute malware, viruses, or other harmful code
- Attempt to reverse engineer, decompile, or disassemble our software
- Attempt to gain unauthorized access to our systems or other users' accounts
- Impersonate another person, organization, or AQYL staff
- Use our Services to facilitate illegal transactions
- Interfere with or disrupt the integrity or performance of our Services
- Collect user information without consent
- Use our Services for commercial purposes without authorization
6. Your Content and Data
You retain ownership of all content you create and share through AQYL. Because your content is end-to-end encrypted, we cannot access, view, or moderate the content of your private communications.
You are solely responsible for the content you share. You represent that you have all necessary rights to share such content and that it does not violate these Terms or any applicable laws.
By using our Services, you grant us a limited license to transmit, store (in encrypted form), and process your content solely as necessary to provide the Services.
7. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Services, you agree to our Privacy Policy.
8. Third-Party Services
Our Services may integrate with or contain links to third-party services (such as link previews or external websites). We are not responsible for the content, privacy policies, or practices of third-party services. Your interactions with third-party services are governed by their respective terms and policies.
9. Intellectual Property
AQYL, the AQYL logo, and all associated trademarks, service marks, graphics, and logos are trademarks of AQYL. You may not use our trademarks without our prior written permission.
Our Services, including all software, designs, text, graphics, and interfaces, are protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.
10. Disclaimers
Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or completely secure.
While we implement strong encryption and security measures, no system is completely secure. We are not responsible for any unauthorized access resulting from factors outside our reasonable control.
11. Limitation of Liability
To the maximum extent permitted by applicable law, AQYL and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, whether incurred directly or indirectly, resulting from your use of or inability to use our Services.
12. Indemnification
You agree to indemnify, defend, and hold harmless AQYL and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of our Services, your violation of these Terms, or your violation of any rights of another.
13. Termination
You may terminate your account at any time by deleting your account through the app settings. Upon termination, your right to use our Services will immediately cease.
We may suspend or terminate your account at any time, with or without cause or notice, if we believe you have violated these Terms or engaged in conduct that may harm us or other users. We may also terminate accounts that remain inactive for extended periods.
14. Dispute Resolution
Any disputes arising from these Terms or your use of our Services shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.
You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration, to the extent permitted by law.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of the United Arab Emirates.
16. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will notify you through our Services, by email, or by other reasonable means. Your continued use of our Services after changes take effect constitutes acceptance of the modified Terms.
We encourage you to review these Terms periodically. The "Last updated" date at the top indicates when these Terms were last revised.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AQYL regarding your use of our Services and supersede any prior agreements.
